Abstract: El objetivo de este trabajo de Fin de Grado es analizar una sentencia que interpuso la marca Longchamp contra Groupon, donde es clave una parte del Derecho de la Competencia, la Competencia Desleal, regulada en la ley 3/1991 del 10 de enero (LCD), los actos de imitación que se recogen en el artículo 11 LCD y que tienen especial importancia en el caso objeto de analizar así como el art. 6 LCD donde se regula la imitación de productos oficiales sobre los que hay un derecho de marca. También es necesario el estudio acerca de la modificación de la LCD que se realizó a través de la ley 29/2009 de 30 de diciembre donde se modifica el régimen legal de la competencia desleal y de la publicidad para la mejora de la protección de los consumidores y usuarios, aparte de tener en cuenta la Ley de Patentes (LP), Ley de Marcas (LM) y la Ley de Protección Jurídica del Diseño Industrial (LDI).
The objective of this Final Degree project is to analyze a sentence filed by the company that owns the Longchamp S.A.S. brand against Groupon S.L., where a part of the Law of Competition, the Unfair Competition, regulated in the law 3/1991 of January 10 (LCD), the acts of imitation that are included in article 11 LCD and that have special importance in the case as well as art. 6 LCD where the imitation of official products on which there is a trademark right is regulated. It is also necessary to study the modification of the LCD that was made through the law 29/2009 of December 30 where the legal regime of unfair competition and advertising for the improvement of consumer protection is modified and users, apart from taking into account the Patent Law (LP), the Trademark Law (LM) and the Law for the Legal Protection of Industrial Design (LDI).
