Resumen: En este trabajo se examina cómo se regula la responsabilidad administrativa de los entes colectivos en el Decreto Legislativo italiano 231/2001, de 8 de junio. Aunque esta responsabilidad se denomina «administrativa», en la doctrina existe un intenso debate sobre su naturaleza jurídica. El estudio de esta norma es conveniente debido a que se trata de una de las regulaciones más precisas y exhaustivas que existen sobre esta materia, la cual ha tenido una gran influencia en otras legislaciones. En concreto, la normativa italiana ha servido de referencia al legislador español en las reformas del Código Penal de los años 2010 y 2015. This paper examines how the administrative liability of collective entities is regulated in Italian Legislative Decree 8 June 2001 No. 231. Although this liability is referred to as “administrative”, there is an intense debate in the doctrine about its legal nature. The study of this document is convenient because it is one of the most precise and exhaustive regulations that exist on this matter, which has had a great influence on other legislations. Specifically, Italian legislation has served as a reference for the Spanish legislator in the reforms of the Criminal Code in 2010 and 2015.
