It will be seen that one of its effects consists of the withdrawal of symbols that had a political meaning in the past. However, currently, they show a religious, historical or artistic sense that makes the application of these regulations debatable. These regulations have also allowed the intervention of public powers over some places of worship and graves. As a result, it is also advisable to study whether their inviolability has been damaged. As a preliminary step in the study of this issue, the author starts by examining whether the legislator is legitimized to enact norms that judge History.
