000148458 5203_ $$aEl art. 77 del Código penal regula la determinación de la pena en los concursos ideal y medial de delitos. La parquedad con que el legislador ha descrito el proceso de concreción de la pena de ambos concursos ha motivado la existencia de numerosas posturas en doctrina y jurisprudencia que ofrecen soluciones dispares para resolver los variados problemas que se van sucediendo en el itinerario que conduce hasta la pena concreta de un concurso ideal o medial de delitos. Creemos conveniente, por ello, volver a indagar sobre el contenido de este precepto, ordenar los distintos posicionamientos que tratan de explicarlo, rechazar aquellos que no nos parecen acertados, adherirnos a los que ofrecen soluciones más plausibles y proponer nuevas vías de entendimiento que ayuden a clarificar esta enmarañada materia.
Article 77 of the Spanish Criminal Code regulates sentencing for ideal concurrent offences —a sole act constituting two or more offences— and medial concurrent offences —one offense is the necessary means to commit another one. The legislator’s vagueness in drawing up the process for sentencing both figures triggered the emergence of several stances in the literature and case-law offering diverse solutions for the assorted problems arising on the path to the specific penalty for both types of concurrent offences. Therefore, we consider it appropriate to delve again into the content of this precept, organize the different standpoints that attempt to explain it, reject those we deem mistaken, adhere to those offering plausible solutions and propose new channels to shed light on this tangled topic.
