El artículo analiza los cambios legislativos y jurisprudenciales que llevaron a la ampliación del matrimonio a las parejas homosexuales en cuatro países latinoamericanos. Se hace hincapié en la relación de esta modificación con los conceptos de secularización y laicidad. En efecto, las sentencias de los tribunales latinoamericanos que han abordado la cuestión del matrimonio han señalado expresamente el proceso de secularización y lo han utilizado en muchos casos como un argumento para una interpretación jurídica favorable a la ampliación del concepto de matrimonio. Juntamente con la secularización, también la laicidad del Estado ha aparecido como argumento.
Same-sex marriage, recently accepted in several Latin American countries, is an example of the secularization of marriage. The arríele discusses the legislative and jurisprudential changes that led to the extensión of marriage to homosexual couples in four Latin American countries. Emphasis is made on the relationship between marriage transformation and the concepts of State religious neutrality and secularization. Indeed, the judgments of the Latin-American courts that have addressed the issue of marriage have expressly pointed out the process of secularization and have used it as an argument for a legal interpretation favourable to the enlargement of the concept of marriage. The concept of State religious neutrality, as well as that of secularization, has appeared as an argument.
