Aunque este Decreto promueve el uso de IA por jueces y fiscales, no es suficiente para superar los desafíos inherentes. Se destacan las funciones de la IA y se señala que no puede sustituir a los jueces. Las actividades procesales son complejas y no pueden reducirse a la simple aplicación lógica de la ley, ya que no consideran las particularidades del proceso de comunicación en la elaboración de sentencias. Se subraya la necesidad de ser conscientes de las características y límites de la IA, por el hecho de que su uso requiere la intervención de personas externas al proceso judicial, lo que puede afectar las funciones de los profesionales del derecho. Finalmente, se mencionan experiencias críticas y opiniones del Consejo General del Poder Judicial sobre la falta de precisión en la regulación española. The text addresses the difficulties of implementing artificial intelligence (Al) in judicial processes in Spain, despite Royal Decree-La.w 612023. Although this Decree promotes the use of Al by judges and prosecutors, it is not sufficient to overcome the inherent challenges. The functions of Al are highlighted and it is noted that it cannot replace judges. Procedural activities are complex and cannot be reduced to the simple logical application of the law, since they do not consider the particularities of the communication process in the prepara/ion of judgments. The need to be aware of the characteristics and limits of Al is stressed, since its use requires the intervention of people externa! to the judicial process, which may ajfect the functions of legal professionals.
