000153697 5203_ $$aLa sostenibilidad y el desarrollo sostenible constituyen dos metas universalmente aceptadas y reconocidas en prácticamente todos los campos del saber. De este modo, todos ellos se han sometido progresivamente a modificaciones y adaptaciones para incluir propósitos y características sostenibles. Más concretamente, el objetivo de las siguientes páginas es profundizar y desglosar la sostenibilidad desde el prisma del llamado concepto paraguas, perteneciente a la ciencia organizativa y desarrollado por Hirsch y Levin. Posteriormente, se elaborará un análisis de la correlación entre la sostenibilidad y la contratación pública sostenible, desde la aproximación inicial de estos dos conceptos hasta su combinación y el alcance de su unión, así como las distintas categorías en las que se puede dividir. Por último, se llevará a cabo un examen dual de la legislación aplicable, estudiándose el impacto de la contratación pública sostenible en la legislación aplicable en esta materia a nivel europeo y nacional. Se resaltarán, por un lado, ciertos aspectos de la relación bilateral entre el influjo de la sostenibilidad en determinados casos de la jurisprudencia del Tribunal de Justicia de la Unión Europea, y algunos artículos de la legislación que han sido particularmente configurados en torno a dicha jurisprudencia. Y, por otro lado, se examinará la transposición de la normativa europea al ordenamiento jurídico español, y el rol que la contratación sostenible ha adoptado en este.
Sustainability and sustainable development are two universally accepted and recognized goals to be achieved in virtually all fields of knowledge. Thus, they have been progressively modified and adapted to include purposes and characteristics related to sustainability. Particularly, the aim of the following pages is to deepen and break down sustainability from the prism of the so-called umbrella concept, which pertains to organizational science and was developed by Hirsch and Levin. Subsequently, the correlation between sustainability and sustainable public procurement will be analysed, starting with the initial approximation of these two concepts, and their combination and the extent to which they can be merged, following with the different categories into which they can be divided. Finally, a dual review of the applicable legislation will be carried out, studying the impact of sustainable public procurement on the applicable European and national legislation. Several aspects will be highlighted: on one hand, certain points of the bilateral relationship between the influence of sustainability in some jurisprudence of the Court of Justice of the European Union, and few articles of the legislation that have been particularly shaped around such jurisprudence. And, on the other hand, the transposition of the European Directives to the Spanish legal system, including the role of sustainable procurement in this procedure, will be examined.
