La cuestiónpresenta la doble complejidad provocada por laausencia en la Ley 8/2021, de 2 de junio, derégimen transitorio específico para las cuestionessucesorias y por el hecho de que la cuestión seplantee extinguida la patria potestad rehabilitada ypendiente la revisión de la medida. Se entiende que,en esa situación, procede adoptar una medidacautelar de citación del Ministerio Fiscal, o, deestar nombrado, al defensor judicial. También seplantea si, pese a la doctrina consolidada de que laprevisión del art. 1057.3 CC se aplica, no solo a loscoherederos a los que se refiere el texto del artículo, sino también a los legatarios de partealícuota pero no a los de cosa cierta y determinada,la condición de legitimario del legatario personacon discapacidad, hace necesaria la citación delrepresentante legal a la realización del inventario,como medida de protección de aquél, en previsiónde una eventual reducción del legado porinoficiosidad. The Directorate General for Legal Certainty andPublic Faith analyses the relevance of summoningthe legal representative of a legatee of a certain anddetermined thing, in a partition carried out by apartitioning accountant, to carry out the inventory.The question presents the double complexitycaused by the absence in Law 8/2021, of 2 June, of aspecific transitional regime for inheritance mattersand by the fact that the question arises once therehabilitated parental authority has beenextinguished and the review of the measure ispending.
