000163055 5203_ $$aLa sentencia limita en el caso concreto la curatela a un contenido asistencial y no representativo, distinguiendo entre apoyo en el ámbito sanitario, con una dimensión de acompañamiento y control, y en el ámbito económico, en el que se concreta que, además de la supervisión y control mensual de movimientos económicos, los actos de disposición que excedan de cierta cantidad precisarán para su validez de la autorización de la curadora. Esto da lugar a reflexionar sobre el significado jurídico del término asistencia como contenido de la medida de apoyo que, desde cierto punto de vista, puede contraponerse al de representación, pero en el que hay que distinguir a su vez, entre un contenido de mero consejo, acompañamiento, en definitiva, asistencia en sentido estricto, y la posibilidad de sujetar determinados actos a autorización del curador: autorización que se situaría en un grado intermedio en la intensidad de la medida de apoyo, entre la mera asistencia y la excepcional función de representación. Todo ello tiene consecuencias en materia de invalidez, del carácter de las obligaciones del curador, la resolución de los desacuerdos entre la persona con discapacidad y su curador o el criterio que debe guiar a este en el otorgamiento de la autorización.
In the specific case, the judgement limits guardianship to an assistance content and not a representative content, distinguishing between support in the health sphere, with a dimension of accompaniment and control, and in the economic sphere, in which it is specified that, in addition to the monthly supervision and control of economic movements, acts of disposition exceeding a certain amount will require the authorisation of the guardian in order to be valid. This gives rise to reflection on the legal meaning of the term assistance as the content of the support measure which, from a certain point of view, can be contrasted with that of representation, but in which a distinction must be made between a content of mere advice, accompaniment, in short, assistance in the strict sense, and the possibility of subjecting certain acts to the curator’s authorisation: authorisation that would be situated at an intermediate level in the intensity of the support measure, between mere assistance and the exceptional function of representation. All this has consequences in terms of invalidity, the nature of the guardian’s obligations, the resolution of disagreements between the person with a disability and his guardian or the criteria that should guide the latter in granting authorisation.
