A continuación, se aborda la jurisprudencia del Tribunal Supremo sobre esta materia desde su Sentencia de 6 de febrero de 2014: Partiendo de la paternidad del padre biológico, se podrá integrar al menor en el núcleo familiar mediante acogimiento o adopción del cónyuge o persona unida al adoptante por análoga relación de afectividad a la conyugal. En cuanto a las Instrucciones de la Dirección General Dirección General de Registros y del Notariado1, desde la de 2010 se permitía la inscripción mediante resolución judicial, en discordancia con la regulación, por lo que la inseguridad en la inscripción eventualmente provocaba vulnerabilidad. Tras la reciente Instrucción de 28 de abril de 2025 sólo se realizará la inscripción a través de los medios ordinarios previstos en el ordenamiento español: filiación biológica, en su caso, respecto de alguno de los progenitores de intención y filiación adoptiva posterior cuando se pruebe la existencia de un núcleo familiar con suficientes garantías. Se valora positivamente la coherencia de la regulación con la jurisprudencia y las Instrucciones de la Dirección General de Seguridad Jurídica y Fe Pública. This article begins with the regulation of surrogacy in Article 10 of the LAHRT: nullity of the contract and the possibility of determining paternity with respect to the biological father. Next, the jurisprudence of the Supreme Court on this matter is addressed since its Judgment of 6 February 2014: Based on the paternity of the biological father, the child may be integrated intothe family nucleus through fostering or adoption by the spouse or person united to the adopter by an analogous relationship of affectivity to the conjugal one. With regard to the Instructions of the Directorate General of Registries and Notaries, since 2010, registration by judicial decision has been allowed, in discordance with the regulation, so that insecurity in the registration eventually caused vulnerability. After the recent Instruction of 28 April 2025, registration will only be carried out through the ordinary means provided for in the Spanish legal system: biological filiation, if applicable, with respect to one of the intended parents and subsequent adoptive filiation when the existence of a family nucleus with sufficient guarantees is proven.
