Transparencia material en la contratación de los préstamos hipotecarios: De la expresión manuscrita de la Ley 1/2013 a los mecanismos llamados a cumplir la misma función en la Ley 5/2019, de 15 de marzo, de Contratos de Crédito Inmobiliario

Resumen: En este trabajo se analiza el tratamiento y los problemas prácticos que ha planteado la exigencia de la expresión manuscrita en la Ley 1/2013 y se examina la regulación que de éste y otros mecanismos ha hecho la Ley 5/2019, de Contratos de Crédito Inmobiliario, así como su evolución durante la tramitación parlamentaria. Finalmente, se aborda el papel de estos requisitos como mecanismo de acreditación del control de transparencia material en los contratos de préstamos hipotecarios.
This paper analyses the treatment and practical problems posed by the requirement of the manuscript expression in Law 1/2013 and examines the regulation that of this requirement and other mechanism has made the Law 5/2019, of real estate Credit Contracts and the evolution that its configuration has suffered during the parliamentary procedure of the Law. Finally, we also study the role of these requirements as a mechanism for accrediting the control of real transparency in mortgage contracts is addressed.
