Juezas de avenencia y árbitras en la Baja Edad aragonesa: una realidad significativa y perdurable

Resumen: El arbitraje es una institución por la que dos partes en litigio eligen a una o más personas para que examinen y busquen una solución al conflicto que las enfrenta. El arbitraje fue la vía más común por la que las mujeres del reino de Aragón ejercieron justicia durante los siglos XIII al XVI. La mayoría de estas árbitras fueron señoras de la nobleza viudas y casadas, aunque también hubo árbitras entre las mujeres de la oligarquía urbana. Ellas mediaron en todo tipo de cuestiones, aunque, en esta ocasión, hemos reparado especialmente en las intervenciones a raíz de violencia física con consecuencia de heridas.
Arbitration is a procedure in which a problem is submitted by the parties to one or more people or arbitrators in order to obtain a binding solution to their dispute. It was mainly through the practice of arbitration that women in the Kingdom of Aragon could deliver justice between the 13th and 16th centuries. Most of these female arbitrators, either married or widowed, belonged to the nobility although there were also cases among the women of the urban elites. They mediated in all kinds of disputes; however, this paper focuses, in particular, on the resolution of violent cases which resulted in wounds and injuries.
