La responsabilidad de las personas jurídicas por los delitos cometidos por sus integrantes en Perú y Argentina

Resumen: Desde hace años, se puede observar una tendencia en el derecho comparado de atribuirles responsabilidad (penal o administrativa) a los entes colectivos por los delitos que han cometido sus integrantes si se cumplen ciertos requisitos. Esta tendencia se ha extendido también en Latinoamérica. En este trabajo, se analiza cómo se regula la responsabilidad de las personas jurídicas en Perú y Argentina. Aunque ambas legislaciones cuentan con aspectos similares, difieren en algunas cuestiones importantes, comenzando por la propia naturaleza jurídica de esta responsabilidad corporativa. Mientras que en Argentina se regula la responsabilidad penal de las personas jurídicas, en Perú se establece un régimen de responsabilidad administrativa de las personas jurídicas por los delitos cometidos por sus miembros.
For years there has been a trend in comparative law to attribute liability (criminal or administrative) to collective entities for crimes committed by their members if certain requirements are met. This trend has also spread in Latin America. This paper analyzes how the liability of legal entities is regulated in Peru and Argentina. Although both legislations are similar in some aspects, they differ on some important issues, starting with the legal nature of this corporate liability. While Argentina regulates the criminal liability of legal entities, Peru establishes a regime of administrative liability of legal entities for crimes committed by their members.
