Las circunstancias atenuantes de la responsabilidad penal de las personas jurídicas previstas en el art. 31 quater CP: ¿sistema de numerus clausus?

Resumen: Desde que se introdujo la responsabilidad penal de las personas jurídicas en el Código Penal en el año 2010, la doctrina ha discutido si es posible aplicar a estas entidades otras circunstancias atenuantes de la responsabilidad criminal que no están previstas expresamente en el art. 31 quater CP, como la de dilaciones indebidas y la llamada atenuante analógica. Aunque conforme a la redacción de este precepto resulta muy complicado admitir que se pueda apreciar en favor de una persona jurídica alguna de estas circunstancias atenuantes, no existen motivos que justifiquen esta decisión legislativa. Por ello, es necesario que se modifique el art. 31 quater CP para permitir expresamente esta posibilidad. Since the introduction of the criminal liability of legal entities in the Criminal Code in 2010, the doctrine has discussed whether it is possible to apply to these entities other extenuating circumstances of criminal liability that are not expressly provided for in article 31 quater of the Criminal Code, such as the extenuating circumstance of undue delay and the so-called extenuating circumstance by analogy. Although the wording of this article makes it very difficult to admit that any of these extenuating circumstances could be applied to a legal entity, there is no reason to justify this legislative decision. Therefore, the article 31 quater of the Criminal Code needs to be amended to expressly allow this possibility.
