Este planteamiento se contrapone con la aspiración de un sector de la comunidad científica que pretende demostrar la determinación causal del comportamiento humano. En este artículo se contrastarán estos enfoques con el propósito de esclarecer si está justificada desde una perspectiva empírico-normativa la atribución de libertad de voluntad a los sujetos en el ámbito penal.
The dogmatic category of culpability has been constructed under the premise that imputable subjects are free to self-determine their behavior consciously. This approach contrasts
with the aspiration of a sector of the scientific community that seeks to demonstrate the causal determination of human behavior. This article will contrast these approaches in order to clarify whether the attribution of freedom of will to subjects in the criminal sphere is justified from an empirical-normative perspective.
