Resumen: En el presente artículo se analizará la responsabilidad penal las personas jurídicas pues estas responden penalmente a algunos delitos del Código Penal español, lo que ha obligado a la ciencia jurídico-penal a preguntarse si es posible y con qué alcance y contenido proyectar la teoría jurídica del delito de las personas físicas a las personas jurídicas de manera que se pueda afirmar, aunque necesariamente a través de sus correspondientes equivalentes funcionales, que el hecho delictivo corporativo puede ser típico, antijurídico, culpable y, en consecuencia, punible.
