Simbología religiosa en la legislación sobre memoria histórica en España

Resumen: This article analyzes the projection of historical memory rules on the fundamental right of religious freedom. It will be seen that one of its effects consists of the withdrawal of symbols that
had a political meaning in the past. However, currently, they show a religious, historical or artistic sense that makes the application of these regulations debatable. These regulations have also allowed the intervention of public powers over some places of worship and graves. As a result, it is also advisable to study whether their inviolability has been damaged. As a preliminary step in the study of this issue, the author starts by examining whether the legislator is legitimized to enact norms that judge History. The text focuses on Spanish Law, but there are numerous references to Comparative Law.
