Ingreso Forzoso durante el Parto: Entre la Autonomía Materna y la Violencia Obstétrica. Análisis de la STC 11/2023, de 23 de febrero

Resumen: El presente trabajo analiza la Sentencia del Tribunal Constitucional español 11/2023, de 23 de febrero, en la que dirime la constitucionalidad de las actuaciones sanitarias tras un ingreso forzoso a una embarazada postérmino cuya voluntad era poder dar a luz en su domicilio y asistida de matronas privadas contratadas a tal efecto. Sin embargo, el parto terminó siendo hospitalario y a través de cesárea en el Hospital Universitario Central de Asturias.
This paper scrutinizes the Judgment of the Spanish Constitutional Court 11/2023, dated February 23, which determines the adherence to the Constitution of health actions following the compelled hospitalization of a post-term pregnant woman whose wish was to give birth at home, attended by privately engaged midwives. Notwithstanding the foregoing, the delivery ended up taking place in a hospital and via cesarean section at the Central University Hospital of Asturias.
