La administración hereditaria en el derecho inglés

Resumen: El Derecho inglés ofrece un sistema sucesorio caracterizado por la interposición de una institución, llamada representante personal, destinada a purgar el pasivo hereditario y distribuir el remanente entre los sucesores del causante. El beneficio económico de la sucesión queda así escindido de las labores de administración del caudal relicto. Esta transmisión intermediada es una de las notas más sobresalientes del fenómeno sucesorio en el Common Law frente a los países romanizados. El artículo estudia comparativamente dicha singularidad que constituye una primera incursión en las operaciones realizadas por el liquidador hereditario desde el fallecimiento del causante hasta la distribución del activo neto entre los diversos beneficiarios distinguiendo entre herencias solventes e insolventes.

English law offers a succession system characterized by the interposition of an institution, called personal representative, intended to cleanse the hereditary liability and distribute the remainder among the successors of the deceased. The economic benefit of the succession is thus split from the tasks of estate administration. This intermediary transmission is one of the most outstanding features of the machinery of succession in Common Law against civilian countries. This paper constitutes an outline of the operations performed by the testamentary executor from the death of the deceased to the distribution of net assets among the various beneficiaries making a distinction between solvent and insolvent estates.
