La sucesión por testamento mancomunado o de hermandad en el nuevo derecho civil vasco

Resumen: Buena parte los actos jurídicos que realizan las personas durante su vida se llevan a cabo de manera individual, como sujetos únicos de determinadas relaciones jurídicas, y sin perjuicio de que el Derecho reconozca en ocasiones la posibilidad de actuar de manera conjunta con otras personas. Cabe pensar que un acontecimiento tan definitivo como disponer de los propios bienes en previsión de la muerte, también debe ser algo singular de cada uno. Sin embargo, igualmente es posible que varios sujetos encuentren interesante la posibilidad de aunar su voluntad testamentaria, otorgando un documento sucesorio único para ambos. En el Derecho español el Código civil prohíbe el testamento mancomunado que sí se admite, en cambio, en algunos territorios forales. Como sucede en el País Vasco, cuyo Derecho civil fue reformado de manera importante en 2015, con el testamento mancomunado o de hermandad.
A large part of the legal acts which people perform along their lifetime are carried out individually, acting as sole subjects in certain legal relationships, notwithstanding the fact that the Law sometimes recognizes the possibility of acting jointly with other individuals. It seems reasonable to consider that a final document such as the will, where disposing of one´s assets in anticipation of death, must be a singular act. However, it is also possible that several subjects find it interesting to unite their will in a single document. In the Spanish Law, the Civil code prohibits joint wills, which have however been admitted in certain regions such as the Basque Country, where the civil law was reformed in 2015.
