Normativa, regulación y vigilancia del proceder ético en la comunicación publicitaria en España

Resumen: Se valoran en este trabajo una serie de cuestiones relativas a la actividad publicitaria. En especial, aquellas relacionadas con la ética en la fotografía o imagen publicitaria. Para ello, se revisan, en primer lugar, la noción de ética en publicidad, en segundo lugar, nos ocuparemos de la Ley de Publicidad española y el sistema de autorregulación de la actividad publicitaria. Asimismo, es importante destacar el papel que juegan el Jurado de Publicidad de Autocontrol, así como, la labor del Observatorio de la Publicidad del Instituto de la Mujer. Finalmente, se presta atención a la figura del fotógrafo profesional publicitario.
This paper addresses a series of issues related to advertising activities; in particular, those related to ethics in photography and the use of images for advertising. To do so, it firstly revises the notion of ethics in advertising and, secondly, it discusses the Spanish Advertising Law and the system of self-regulation of advertising activities. In addition, it is important to highlight the role played by both the Spanish Jury of Self-Regulation and the Advertising Observatory of the Women’s Institute. Finally, the figure of the professional advertising photographer is discussed.
