La autonomía privada como límite a la regulación legal de las parejas de hecho

Resumen: La admisión del matrimonio gay ha supuesto en materia de parejas de hecho un punto de inflexión que hace innecesaria la tendencial equiparación entre dos realidades familiares que son diferentes. Tras la STC 23 abril 2013 (RTC 93) se invierten los términos habituales y la autonomía privada queda constituida como un límite a la acción del legislador. En este nuevo escenario quienes no operen con suficiente diligencia y precaución se ven condenados a una convivencia prácticamente huérfana de cualquier respaldo jurídico. No parece, sin embargo, que tal aproximación, entre utópica y libertaria, resulte la más propicia a los interesados cuyos intereses quedarían mejor atendidos mediante una regulación estatal mínima de carácter dispositivo que después pudieran modificar a su gusto.
The admission of gay marriage has been a turning point in the matter of civil partnership, which makes unnecessary the tendency to equate two family realities that are different. After the STC 23 April 2013 (RTC 93) the usual terms are reversed and private autonomy is constituted as a limit to the action of the legislator. In this new scenario, members of the unmarried couple who are not diligent and cautious enough are condemned to an almost orphan coexistence of any legal support. It does not seem however that such an approach -between utopian and libertarian- is the most propitious to those whose interests would be better served by a minimum state regulation of dispositive nature that later they could modify to their liking.
